Who Is a Martyr

Issue No.603- As it was said earlier, it is obligatory to give ghusl and shroud the dead body of a Muslim. However, two groups are an exception to this rule:The first group: “The Martyrs in the way of Allah”, i.e., those who have been killed in a battlefield in a holy war for the sake of Islam while accompanying the Prophet (ṣ), the Infallible Imam (as) or his specific deputy. Also, those who are killed defending against the enemies of Islam during the occultation of Imam Mahdi (as), (may our souls be sacrificed for him), giving ghusl, shrouding and camphorating are not obligatory, irrespective of whether those who are killed are man or woman, adult or child; they should be buried with the clothes they have on after offering prayer on them.

11) The Rules of One’s Hometown (Waṭan)A place is considered one’s hometown if it meets one of the following three criteria:1) Having the intention to reside in a place for a lengthy period of time (e.g., a year or more).2) Residing at a location at least three days weekly for a minimum of two years.3) Residing at a location at least four cumulative months of the year (if even sporadically) for a minimum of three years. In any of the aforementioned scenarios, that location will be considered a person’s hometown. Consequentially, prayers and fasts must be fulfilled in their entirety and there will no longer be a need to make a ten-day intention of residence.

12) Frequent Travellers (Kathīr al-Safar)A person is considered a “frequent traveler” if they meet one of the follow four criteria:1) If they travel each day of the month—even with the exception of Sundays.2) If, during a 45-day period of time, they travel five days per week.3) If, during a two-month period of time or more, they travel a minimum of three days a week (or 12 days a month).4) If, during a minimum period of two months but no more than two years, they reside at a specific location at least three days per week.In any of the aforementioned scenarios, a person is considered a frequent traveller whose prayers and fasts during the course of travel must be fulfilled in their entirety.

66) How to Compensate for Ḥaqq al-Nās

66) How to compensate for ḥaqq al-nās (the rights of people)Concerning ḥaqq al-nās, if a person has violated the rights of another, they should first attempt to compensate for it or reach a compromise with them. If this is not possible, they should compensate for the other’s loss by means of a third party, deposit into a bank account, or sending a package by mail. If this is also not possible, one may give charity to the needy on behalf of the individual to whom they are indebted.

Duty of One Who Searches for Water Before the Time for Prayer

Issue No.616- If a person makes search for water before prayer time, and does not find it, and stays there until the time for prayer, it is not necessary for him to go in search of water again, unless there has been a change in the circumstances of the place. Also if he makes search for water for one prayer, it is not necessary to do it again for other prayers when there is no change in the circumstances.

Issue No. 619If It Is Not Possible to Obtain Enough Water for Wuḍū and Ghusl

One Who Is Certain That He Will not Find Water and Does not Look for Water

Issue No.619- If a person is sure that he cannot get water and does not, therefore, go in search of water and offers his prayer with tayammum, but realises after prayer that if he had made an effort he would have attained water, his prayer is void. Similarly, if after searching and not finding water, he made tayammum and offered his prayer then realized later that water was available at the place where he had searched, he should, as an obligatory precaution, make wuḍū and repeat the prayer and if the time of the prayer has elapsed, he should perform the qaḍā of the prayer.

Issue No.10- If a Mujtahid whom one follows dies, he may still follow him, and indeed if he is more learned than a living Mujtahid, it is obligatory to follow him in issues which the demised Mujtahid disagrees with others, provided that he has previously acted on his fatwā.
