Issue No. 2385Inheritance of the Third Group

If the Heirs Are Only One Father's Maternal Uncle and Aunt and Real Maternal Uncle and Aunt and Mother's Maternal Uncle and Aunt

Issue No.2385- If the heirs of the deceased are the maternal uncle and aunt from the same father, along with the maternal uncle and aunt from the same mother and also real maternal uncle and aunt, the maternal uncle and aunt from father’s side will not inherit, and the property should be divided into three parts, one part will be divided equally between the maternal uncle and aunt from mother’s side and the remaining parts will go to the real maternal uncle and aunt who will divide it among themselves equally.

If the Heirs Are Only One Mother's Maternal Uncle or Aunt and Real Maternal Uncle and Aunt and Father's Maternal Uncle and Aunt

Issue No.2384- If the heirs of the deceased are one maternal uncle or aunt whose mother is the same with the deceased's mother, along with a full-blood uncle and aunt (i.e., from the same parents of the deceased), and also a maternal uncle and aunt, the latter will not inherit, and the property will be divided into six parts, one part will go to the maternal uncle and aunt from the mother’s side, and the remaining parts will go to the full-blood maternal uncle and aunt who will divide it among themselves equally.

If the Heirs Are Only Parents and a Daughter

Issue No.2357- If the heirs of a deceased are only his father, mother and his one daughter, the property will be divided into five parts, out of which the father and the mother take one share each, and the remaining three shares are taken by the daughter. In case the deceased has two brothers or four sisters or one brother and two sisters from the same father of the deceased, the property will be divided into six parts. The father and mother will each take one part, and three parts will be taken by the daughter. As regards the remaining one part, the father and the daughter will divide it between themselves, and as a recommended precaution they should make a compromise in this division.

Issue No. 2358Inheritance of the First Group

If the Heirs Are Only Parents and a Son

Issue No.2358- If the heirs of the deceased are his father, mother and one son only, the property is divided into six parts, from which one is taken by the father and one by the mother, and four by the son. In case, the deceased has several sons or daughters, they divide the said four parts equally among them. If, however, he has several sons and daughters, the four shares are divided among them in such a way that each son gets double the share of each daughter.

Issue No. 2370Inheritance of the Second Group

If the Heirs Are Only Paternal Half Brothers and Sisters and two or moreMaternal Half Brothers or Sisters

Issue No.2370- If the only heirs of the deceased are his paternal brothers and sisters, and two or more maternal brothers and sisters, the property will be divided into three parts. One part will be shared among the maternal brothers and sisters equally, and the remaining two parts will be divided among the paternal brothers and sisters in such a manner that every brother gets double the share of every sister.

If the Heirs Are Only a Maternal Uncle or Aunt, and Paternal Uncle and Aunt

Issue No.2387- If the heirs of the deceased are one maternal uncle or aunt along with one paternal uncle and aunt, in case, the paternal uncle and paternal aunt are from the same parents or from the same father with the deceased, the property will be divided into three parts, one part will go to the maternal uncle or aunt and out of the remaining parts, two parts will be given to the paternal uncle and one part to the paternal aunt. Hence, if the property is divided into nine equal shares, three shares will go to the maternal uncle or aunt, and four shares to the paternal uncle and two shares to the paternal aunt.

If the Heirs Are Only the Parents of the Deceased

Issue No.2356- If the father and the mother of a deceased are his only heirs, the property is divided into three parts, out of which two parts are taken by the father and one by the mother. If the deceased has two brothers or four sisters, or one brother and two sisters, who are all from the same parents or are related to him from the side of the father only, the mother gets one-sixth of the property and the rest is inherited by the father.

If the Heirs Are Several Real Maternal Uncles and Aunts or Father's or Mother's Maternal Uncles and Aunts, and the Deceased Has Paternal Uncle and Aunt Too

Issue No.2390- If the heirs of the deceased are several maternal uncles and aunts who are all from the same parents or from the same father or mother, together with paternal uncles and aunts, the property will be divided into three equal shares, two shares will be divided among the paternal uncles and aunts among themselves in accordance with the rule stated in the previous issue, and one share will be divided equally among the maternal uncles and aunts.
