Issue No. 1288Rulings of Āyāt Prayer

If the Causes of Āyāt Prayer Occur Several Times

Issue No. 1288- If the event, which makes āyāt Prayer obligatory, occurs several times, one should offer āyāt Prayer for each one of them. For example, if an earthquake takes place a number of times, or a solar eclipse and an earthquake occur at the same time, one should offer separate āyāt Prayers for each of them. However, if these occurrences take place while a person is offering āyāt Prayer, one āyāt prayer will suffice.

Issue No. 1864Miscellaneous Of Lease

If the Commencement and the End of Lease Contract has not been Fixed

Issue No.1864- If the lessor says to the lessee, “I have leased out this house to you for one month on a rent of £500.00, and so long as you stay in it thereafter the rent will be the same”, the lease will be in order only for the first month, because the rest has not been specified. However, if the first month is not specified also, and he only says that the rent is £500.00 a month, the lease is completely void.

Issue No. 1974Conditions of the Property Mortgaged

If the Debtor has nothing Except the Essential Properties for Life

Issue No.1974- If the debtor has not paid any mortgage and if he does not possess anything other than his house which he resides in, and the essential household effects, the creditor cannot demand the repayment of debt from him, rather, he should give him time. However, if he has mortgaged a property, the creditor may sell it and collect his dues (even if the property is one of the exempt items listed above).

Issue No. 1943Rules Regarding Debt or Loan

If the Debtor has nothing except Urgent Properties for Life

Issue No.1943- If the creditor demands his debt at the time he is entitled to, and the debtor is in a position to pay it he should pay it immediately, and if he delays the payment, he has committed a sin. However, if the debtor does not possess anything other than the house he resides in, the household effects, and other essential objects, the creditor should wait and he cannot compel him to sell the things he needs. However, the debtor should endeavour to repay his debt through trade and work or other lawful ways to earn some money to pay his debt.

Issue No. 2401Inheritance by the Husband and the Wife

If the Deceased Has More Than One Wife

Issue No.2401- If a deceased has more than one wife and no children, one-fourth of the property, and if he has children, one-eighth of the property is divided equally between the wives in the manner explained above, even though the husband may not have had sexual intercourse with them. However, if he marries a woman during an illness as a consequence of which he dies, that woman will inherit from him only if he had sexual intercourse with her.

Issue No. 546Rules regarding the Shroud

If the Deceased Has no Property

Issue No.546- If the deceased has no property, it is not obligatory for the relatives of the deceased to provide his shroud, even though they were legally responsible for his maintenance during his lifetime. However, if there is no other way the one who was legally responsible for his maintenance should provide his shroud as an obligatory precaution.

Issue No. 516Rules regarding the Dead

If the Deceased Is a Pregnant Women

Issue No.516- If the dead person is a pregnant woman and there is still a living child in her womb, or the child is likely to be alive, her left side is cut open and the child is taken out and then her side is sewn. If there is access to experts, this should be done under their supervision.

Issue No. 2445Transplanting and Anatomy (2444)

If the Deceased Permitted in his Lifetime

Issue No. 2445- If a person gives permission in his/her life time that the limbs of his/her body be removed after his/her death and be given to others, or his/her guardians give permission after his/her death for the same, the ruling of Diya (compensation) and other related rules remain the same and are not changed, and the precaution is that compensation should be paid under any circumstances.
