If Cleansing a Part of the Mosque Is Not Possible without Demolishing It

Issue No.826- If a place in a mosque becomes najis, and it cannot be made ṭāhir without digging or demolishing it, the place should be dug or demolished if it does not cause considerable destruction. And the place that has been dug or demolished should, as an obligatory precaution, be repaired and turned into its original form. It is better that the person who made it najis, should take the responsibility for the repair. Anyhow, he is liable for the expenses, as an obligatory precaution.

If Deceased Has no Sisters and Brothers

Issue No.2372- If the deceased does not have any sisters or brothers, their share of the inheritance is given to their children, and the share of the maternal brother’s child and maternal sister’s child will be divided among them equally. And as for the share of the paternal brother’s child and paternal sister’s child, or full-blood brother’s and sister’s child, the commonly held principle is that every son gets twice as much as the daughter. However, if the paternal brother’s children or the full-blood brother’s children are of the same brother, the obligatory precaution is that they should resort to a compromise about the difference of the amount between the boys and girls.

If Deceased Is Indebted

Issue No.2407- If the deceased has a debt equal to his property or more, the four things which were mentioned in the preceding issue do not belong to the eldest son, and should be given for the repayment of the debt. However, if his property is more than the debt, and his debt can be paid off and even considerable amount is also left for the heirs, then those four things should be given to the eldest son.

If Divorce Occurs During Woman's Hayz or Nifas

Issue No. 2139- If a man thinks that his wife is pure from ḥayḍ and divorces her, but it transpires later that at the time of divorce she was in the state of ḥayḍ, the divorce is void. On the contrary, if he knows that she is in the state of ḥayḍ and divorces her, and it transpires later that at the time of divorce she was not in the state of ḥayḍ, the divorce is valid.

Issue No. 2404Inheritance by the Husband and the Wife

If Husband Divorces his Sick Wife and she Dies after One Lunar Year

Issue No.2404- If a husband divorces his wife during his illness and dies before the lapse of twelve lunar months, the wife inherits from him on the fulfilment of three conditions:1) That the husband dies during the illness in which he divorced her.2) That the woman does not marry after the divorce and completion of the ‘iddah.3) The divorce should not have been of the woman’s accord, and if it had been so, she would not inherit as per obligatory precaution.

Issue No. 2065Rules of Permanent Marriage

If Husband Does Not Provide Wife with Maintenance

Issue No. 2065- If the wife asks the husband for maintenance and he does not provide her, she can draw her daily expenses from his property every day without his permission, and the obligatory precaution is that she should do so with the permission of the Mujtahid. In case however, she has no choice but to earn her livelihood, it will not be obligatory upon her to obey her husband while she is engaged in earning her livelihood.
