Fish in Muslim Markets

Issue No. 2251- If a fish is bought from Muslim markets or is given by a Muslim hand, it is halal, though it may not be known whether it was caught alive from water or not; and it is not necessary to investigate about it. However, if it is bought from an unbeliever, and it is not known whether or not it was caught alive from water, it is haram.

Fitra for Labours or Staffs

Issue No. 1707- If a person employs someone and agrees to meet his expenses (i.e., a servant), he should pay his fiṭrah. However, this does not apply to the labourers whose expenses are met by their employer as a part of their wages; thus, it will not be obligatory on him (employer) to pay their fiṭrah. Similarly, in guest houses and the like, where it is common for the staffers to have their meals there, and in fact, the food that they eat is considered to be part of their wages, it is obligatory on them to pay their fiṭrah themselves and the employer would be under no obligation.

Issue No. 1708- The expenses of soldiers in the barracks or in the battlefields are the government’s obligation, however, it is not obligatory on the government to pay their fiṭrah, and if they bear the conditions, they should pay their own fiṭrah.

Fitra for a Person Dies After Sunset of last day of Month

Issue No. 1709- If a person dies after sunset of the eve of Eid al-Fitr his fiṭrah as well as that of the ones whose maintenance is obligatory on him, should be paid out of his property. In case however, he dies before sunset, the payment of his fiṭrah is not obligatory; and in case the conditions of the obligatory payment of fiṭrah apply to the members of his family, they themselves should pay their own fiṭrah.

Issue No. 1703- If the husband of a woman does not bear her expenses and somebody else is paying for her expenses, it is obligatory on that person to pay her fiṭrah. In case a woman [who is not poor] earns money and spends her income for her expenses, she should pay her fiṭrah herself, provided that she is not poor.

Five Cases in Which Adhān Should Not Be Recited

Issue No.844- The adhān recitation is not to be said in the five following cases and should not be recited, as an obligatory precaution:1- Adhān of ‘aṣr prayer on Friday if it is offered together with the Friday prayer.2- Adhān of ‘aṣr prayer on the day of ‘Arafah which is the ninth of DhulHijjah, if it is performed together with ẓuhr prayer.3- Adhān of ‘ishā’ prayer on the night of Eid al-Adha for a person who is in Mash‘ar al-Ḥarām when it is offered together with maghrib prayer. 4- Adhān of ‘aṣr and ‘ishā’ prayers of a mustaḥāḍah woman who has to offer them immediately after ẓuhr and maghrib prayers, respectively. 5- Adhān of ‘aṣr and ‘ishā’ prayers of a person who cannot control his urine or faeces.In general, in any prayer offered together with another, [the recitation of the] adhān for the latter prayer is not necessary, and the gap in between the two prayers for nawāfil or supplications does not harm the rule. However, if they are offered separately in their meritorious times, then adhān and iqāmah are recommended for both of them.

Five Conditions of the Place of Prayer

Issue No.792- The place where one can offer his prayer should bear the following conditions: First: being permissibleThe place on which a person offers his prayer should, as an obligatory precaution, be permissible. Therefore, if a person is offering prayer on a usurped property, a usurped carpet or bench, his prayer is void as an obligatory precaution. Similarly the prayer on a property which its benefits belong to someone else (like a rented house) without the beneficiary's consent, is void as an obligatory precaution. And the same rule applies when somebody's right is included in some property. For instance if a person made a will before his death that one-third of his property should be used in a particular manner, prayer cannot be offered in that property if the will has not been executed.

Issue No.670- It is obligatory to perform the following five prayers during the day and night:The ẓuhr and ‘aṣr prayers each consist of four rak‘ats, the maghrib prayer of three rak‘ats, the ‘ishā’ prayer of four rak‘ats and the fajr prayer of two rak‘ats. However, while travelling, a traveller should reduce the four rak‘at prayers to two. The conditions for reducing the rak‘ats will be covered later inshallah.

3 - Folding Hands during PrayerIssue No.1008- The third invalidator is to fold hands in the way some Muslim schools of thought do. If a person folds his hands or puts them on his chest, even as a mark of humility and reverence, the obligatory precaution is that he should repeat the prayer, even if it does not look like them. However, there is no harm if it occurs forgetfully or inevitably, or for some other purposes such as scratching the hand (or similar actions).

Issue No. 1233- When an imam is leading a congregation for the daily prayers, one can follow him for any of the daily prayers. For example, if the imam is offering ẓuhr prayer, and one has already offered his ẓuhr prayer, he can offer his ‘aṣr prayer following the imam. However, if the imam is repeating his prayer in order for precaution, he (the follower) cannot offer his prayer with him, unless both of the prayers are similar in terms of precaution.
