Issue No. 2398Inheritance by the Husband and the Wife

Wife Possessing things which he has no Right to Possess

Issue No.2398- If the wife wishes to have any right of discretion over things from which she does not inherit (for example, the land and the building of a house) she should obtain the permission of the other heirs to do so. Also, it is not permissible for other heirs to appropriate, without the permission of the wife, those things from which she inherits (for example, buildings), unless her share from those things has been paid to her by them. And if they sell it before giving the wife’s share, the transaction will be in order if the wife gives permission, otherwise it will be void with respect to her share.

Issue No. 2043- If a man marries a woman, even if he may not have had sexual intercourse with her, her mother, her mother’s mother, her father’s mother and all the women as the line ascends are his maḥram. However, the daughter of one’s wife, and the grand daughters of that woman (daughters of daughters or sons) will become haram to that man if he has had sexual intercourse with her.

Wiping on Socks and Shoes

Issue No.277- The wiping must be on the skin of the feet. Therefore, wiping on socks or shoes is void unless when one is exercising taqīyyah (dissimulation). However, if one is unable to take off his shoes or socks because of severe cold, or fear of robbers, beasts, etc., it is sufficient to wipe on them, and in the case of the top of the shoes being najis, one can put something ṭāhir on them and wipe on them.

Issue No.650- The forehead and backs of the hands should be wiped entirely; if a person leaves out a small part of his forehead or the backs of his hands in tayammum, intentionally or forgetfully, his tayammum will be void. However, it is not necessary to be very particular about it; if it can be said that the forehead and the backs of the hands have been wiped, it will be sufficient.

Issue No.281- Since it is necessary for the water that the head and the feet are wiped with to be water of wuḍū, when immersing the arms, one should make the intention that the water running down from his arms after taking them out of the water is all part of wuḍū. Otherwise, the head and feet cannot be wiped with this water as an obligatory precaution.

Issue No. 2159- It is not necessary for 'return' to take place for the man to call any person to witness or inform his wife. If he says, “I have re-joined my wife”, the 'return' is in order, even if no one comes to know about it.
