Vomiting Involuntarily

Issue No. 1390- If a person eats something at night that he knows he will vomit involuntarily during the day, the fast will not become void. However, the recommended precaution is that he should not do so, and if he does, he should [as a recommended precaution] offer the qaḍā of that fast.

Issue No. 2287Rules and Conditions Regarding Vow

Vow until the Specified Time

Issue No. 2287- If a person vows to abandon an act for some specified time, it is permissible to perform it after that time has passed. However, if he performs it before that time due to forgetfulness or compulsion, he will be under no obligation but, it will be necessary for him to refrain from that act for the remaining time and in case he repeats that act before the end of the specified time without any excuse, he must offer kaffāra for it in accordance with what was mentioned in the previous issue.

Issue No. 2292- If one vows to perform the Zīyārat of a particular holy Imam, for example of Imam al-Husayn (as), if he goes for the Zīyārat of another Imam, it will not be sufficient. However, if he cannot perform the Zīyārat of that particular Imam because of an excuse, he will be under no obligation.

Issue No. 2079- ‘iddah(waiting period) should be observed in temporary marriage (as will be explained in the divorce section), after its fixed duration has come to an end, and the children born from temporary marriage have all the rights of one’s children and inherit from their parents and their relatives, though the couple do not inherit from one another.

Issue No.201-The sole of the foot or shoe does not become ṭāhir by walking on wooden floor as an obligatory precaution. However, it will become ṭāhir by walking on asphalt.

Issue No. 2309Rules and Conditions Regarding Waqf

Waqf Forever

Issue No. 2309- If a person endows a property, he should, as a recommended precaution, set the beginning of the endowment from the time he is uttering the formula, and not determine an end for the endowment. Therefore, if he says, "This property will stand endowed after my death" the endowment is not in order, or if he says, “This property remains endowed for ten years from now”, it is not in order either. But, one can endow a property forever, with the condition of the first few years’ worth of its benefits being at the disposal of the endower or another person and no one else being able to make use of it.

Issue No. 2306Rules and Conditions Regarding Waqf

Waqf Formula

Issue No. 2306- The formula for endowment (waqf) can be uttered in Arabic or any language, for example, if a person says, “I have endowed my house for a certain purpose”, that will be sufficient and formal acceptance is not required, irrespective of whether it is for the public or for a particular group of people. However, the recommended precaution is that in the endowment for the general public, the Mujtahid or his representative, and in the endowment for a particular group of people, the people for whom the endowment has been made, utter the formula of acceptance.

Issue No. 2310Rules and Conditions Regarding Waqf

Waqf Property must be Possessed by those for whom Was is Done

Issue No. 2310- An endowment will be valid when the property endowed is placed at the disposal of those for whom the property has been endowed, or their representative or legal guardian. However, in public endowments like mosques, schools, etc., surrendering them is not a precondition for the validity of the endowment, though the recommended precaution is that after uttering the formula, it should be placed at the disposal of those for whom the property has been endowed so that the endowment becomes complete.
