Transacting Barely with Wheat

Issue No.1773- From the point of usury, barley and wheat are commodities of one and the same sort. Hence, one cannot exchange 10 kgs of wheat for 12 kgs of barley, and vice versa. Even if one buys 10 kgs of barley on the condition that he would give in exchange 10 kgs of wheat at the time of its harvest, it is also haram, because he has taken barley on the spot and will give wheat some time later, and this amounts to taking something in excess.

Issue No. 1786Commodity and its Substitute

Transacting with Endowed

Issue No.1786- Transactions on endowed property are void. However, if it is spoiled to the extent that it cannot be used for the purpose which it was endowed for, like, if the carpet of a mosque is in a bad state that it is not possible to perform prayer on it, there is no objection in selling it. Similarly, old building materials which are no longer needed for reconstruction of the mosque, can be sold and the money acquired in this way should be spent in the same mosque for the same purpose. In case if this is not possible, it should be spent for a purpose which is nearest to the intention of the endower and if it is not needed for that mosque, it can be used in other mosques.

Issue No.1779- If a person sells the property of another person without his consent, and later the owner of the property consents and assures permission, the transaction will be valid.

Transaction by the Money which its Khums has not been Paid

Issue No. 1480- If a person purchases a commodity with money that is entitled to khums, the transaction will be invalid with respect to the amount of khums due, unless a Mujtahid or his representative gives permission for it. In this case, he should give one fifth of the purchased commodity to the Mujtahid or his representative.

Transaction of Gold with God and Silver with Silver

Issue No.1809- If gold is sold for gold, and silver is sold for silver (whether it is in the form of coins or not) in case the weight of one of them is more than that of the other, the transaction is haram and void, even though one may be manufactured gold and the other unmanufactured, or their make may be of different quality or of different carats, for example, if one gram of 18-carat gold is exchanged for 1.5 grams of 14-carat gold, it will be haram and void. However, there is no harm in selling gold in exchange for silver, irrespective of whether their weight is equal or not.

Transaction with an Immature Person is Void

Issue No.1776- Transaction with an immature person is void even though his legal guardian permits him such. However, there is no harm if the transaction is made with the guardian of the child and the minor serves as a means of giving money to the seller or the commodity to the buyer but the seller and the buyer should be certain that the child will take the commodity or the money to its owner.

Transferring Food from a Gold or Silver Dish

Issue No.252- If there is food in a gold or silver container and one transfers it to another container with the intention of preventing haram, it is permissible but if he does not have this intention, the transfer is haram. Nonetheless, eating from the second container is permissible.

Issue No. 1577Uses of Khums

Transferring Khums from one Town to another is Permissible

Issue No. 1577- There is no harm in transferring khums from one town to another whether there are deserving sayyids in his town or not. However, if it is lost, the obligatory precaution is that he should pay it again from his own property, and he himself should bear the transportation costs. If he gives it to the representative of the Mujtahid, and he takes it from one town to another and it is lost, the khums payer will be under no obligation.

Issue No. 1907Rules Regarding Musaqat

Transferring Land in order to Implant Tree

Issue No.1907- If a person hands over a piece of land to another person to plant trees in it, and it is agreed that whatever is grown, will be the property of both of them, in case all aspects of the contract are made clear, the transaction will be in order, though it cannot be called musāqāt.
