Cases in which the Creditor does not have the Right of Terminate

Issue No. 1983- If a person was capable of paying the debt of the creditor at the time he stood as a surety, the creditor cannot cancel his guarantee and demand the payment from the first debtor, even if the guarantor may have become poor afterwards. And the same rule will apply if the surety at the time of guaranteeing was not capable of paying the debt, yet the creditor agreed to his becoming the guarantor despite knowing it. However, if the surety at the time of guaranteeing was not capable of paying the debt, and the creditor was not aware of it, and he comes to know about it afterwards, he can cancel his guarantee.

Issue No. 1613- If a person dies with a debt and also has some crops, and the heirs pay his debt from other property before zakāt on the crops becomes obligatory, the heir whose share reaches the taxable limit of zakāt should pay zakāt. However, if the heirs do not pay his debts before zakāt becomes obligatory, and if his property just equals his debt, it is not obligatory for the heirs to pay zakāt.

Issue No.1990- If a person gets a debtor released from the hands of his creditor by force and the creditor has no access to the debtor the person who has got the debtor released should hand him over to the creditor or pay his dues. In case a person or persons take over a murderer from the hands of the owner of blood money [in Islamic justice] and let him escape, the Mujtahid or his representative can jail that person or those persons until they hand over the murderer through their own relatives, and if it is not possible to hand over the murderer, they should pay the blood money of the murdered person.

Certainty about Wiping the Forehead and Back of the Hands

Issue No.651- In order to be sure that the forehead and the backs of the hands have been wiped entirely, one should include the surroundings of these parts slightly, but wiping between the fingers is not necessary. As an obligatory precaution, the forehead and the backs of the hands should be wiped from top to bottom, and the parts of tayammum should be performed consecutively, thus if a person leaves such a gap between them that tayammum loses its form, his tayammum is void.

Issue No.139- Those who have waswās [1] must not pay attention to their own certainty in matters related to ṭahārah and najāsah; rather they must observe those cases in which ordinary people become certain about something being ṭāhir or najis, and act accordingly. The best way to be released from obsession is to ignore it.

Issue No.460- If a woman with a regular period sees blood one or two days earlier or later than her normal period, such that it is said that her period has been moved around, although that blood does not have the signs of menses, she should act according to the rulings for ḥā’iḍ (menstruating) women.
