Issue No. 2052Those with Whom Marriage Is Haraam

To Wed a Woman with whom Made Marriage Contract within Waiting Period

Issue No. 2052- If a man contracts marriage with a woman who is in the ‘iddah period of another man, and if the man and the woman both know, or any one of them knows that she is in ‘iddah and also knows that marrying a woman during this state is haram, that woman will become haram for the man forever, irrespective of whether he has had sexual intercourse with her or not. However, if none of them knew that she was in ‘iddah nor did they know that contracting marriage during ‘iddah is haram, if they have had sexual intercourse with each other, the woman becomes haram to him forever, and if they have not had sexual intercourse, she does not become haram to him and they can marry each other after the ‘iddah. If their agent had executed the marriage formula on their behalf instead of them doing it directly themselves, they will not became haram forever in either of the two cases and can get married after the ‘iddah.

Issue No. 2330Person's Duty When Observing the Signs of Death

To Will about Obligatory Hajj or Delayed Complementary

Issue No. 2330- If a person who sees signs of death in himself has a debt of khums, zakāt and maẓālim or has other liabilities, he should make necessary payments at once. And in case he cannot make payments and if he owns property or there is a probability that his friends or relatives will make these payments, he (the person in his deathbed) should make a Will in this regard. The same rule applies if he has obligatory ḥajj on him or lapsed fasts and prayers; the obligatory precaution is that he should make a Will (taking into account what was said earlier about the rules of hired prayers and fasts).

Issue No. 2337- If a person makes a Will that 1/3 of his property should be retained and its income should be spent for some particular purpose, his instructions should be followed.

Issue No. 2336- If a person, sick with an illness that eventually leads to his death, while being completely conscious and aware, bestows something on someone and submits it to him, or gives significant or insignificant discounts to his customers, it will be in order, although the recommended precaution is to come to a compromise with the heirs regarding the excess of the 1⁄3of his property.

Issue No. 1711Usages of Zakat of Fitra

To be Just is not Provision

Issue No. 1711- It is not necessary for the poor person receiving fiṭrah to be just. However, the obligatory precaution is that fiṭrah must not be given to one who drinks wine or a person who commits major sins openly. Also, fiṭrah should not be given to a person who spends it on sinful acts.

Issue No. 1692Zakat of Fitra (Fast-Breaking)

To whom Paying Zakat of Fitra is Obligatory

Issue No. 1692- At the time of sunset during the night of Eid al-Fitr (i.e., the night preceding Eid day), it is obligatory on whoever is sane, needless and mature to give zakāt of fiṭrah to a deserving person, on his own behalf as well as on behalf of those whose maintenance is obligatory on him. Zakāt of fiṭrah per person is about three kilos (one ṣā‘) of food which is common in his area, such as wheat, barley, date, rice, corn, etc. It is also sufficient if he pays the price of one of these items.

Issue No. 2262- It is haram to eat or drink anything which is significantly harmful to one’s health. Smoking cigarettes and other kinds of tobacco products especially narcotics is also haram whether it be in the form of injecting, smoking, taking or using it in any other way. Similarly, it is haram to produce, buy and sell them or help in the spread of such things. It is obligatory on people who are addicted to cigarettes or narcotics to try for addiction treatment.
