Issue No. 1102Rules regarding Sajdah Al-Sahw

To Make Error in Zikr

Issue No.1102- If a person forgetfully says “اَلسَّلامُ عَلَيْکَ اَيُّهَا النَّبِىُّ وَ رَحْمَةُ اللّهِ وَ بَرَکاتُهُ”, sajdah al-sahw will be recommended and not obligatory upon him. But if he says a part of the other two salāms, the obligatory precaution is to perform sajdah al-sahw. If at a place where the salām should not be said, a person forgetfully says the three salāms, it will be sufficient to perform sajdah al-sahw.

Issue No. 1627Zakat on Livestock (Animals)

To Rent or Purchase the Pasture

Issue No. 1627- zakāt should be paid on these animals even though one might have purchased or leased a pasture in order for them to graze, which has not been cultivated by anyone or if he bears expenses for grazing them in it. Of course, these expenses can be deducted.

Issue No. 1942Rules Regarding Debt or Loan

To Repay the Fixed-Time Debt before the Expiry Time

Issue No.1942- If a period is fixed for repayment of the debt in the formal contract of the debt, and the debtor wishes to pay his debt before the termination of time, the creditor does not have to accept it. In case however, specifying the time has been only to help the debtor and he pays his debt before the termination of time, the creditor should accept it.

Issue No. 1753Haraam and void Transaction

Issue No.1753- There is no harm in selling something najis, which can be made ṭāhir by rinsing, like fruit, fabrics and carpets. However, if the customer is intending to make use of it for a purpose which ṭahārah is required, it is necessary for the seller to inform the buyer about the najāsah contained.

Issue No. 1754Haraam and void Transaction

Issue No.1754- If something ṭāhir like oil, which is impossible to be rinsed, becomes najis, in the case whereby it is used for eating alone, its sale is void and haram. However, if it can be used in a way which ṭahārah is not required such as najis oil, the transaction would then be in order.

Issue No. 1679Miscellaneous Issues

To Transmit Zakat to another City if there is not Deserving Person in the City

Issue No. 1679- If none of those who are entitled to receive zakāt are available in one’s area, and he does not consider it probable that he will be able to find a deserving person later, he should take the zakāt to some other place, and spend it in its appropriate way. He cannot deduct the expenses of taking it to the other town, from zakāt, and he is not responsible if it perishes.

Issue No. 2046Those with Whom Marriage Is Haraam

To Wed Sister-in-law

Issue No. 2046- If a man marries a woman (whether the marriage is permanent or temporary), he cannot marry his wife’s sister, as long as she is his wife. Even after divorce, as long as she is in ‘iddah (the waiting period), if it is the ‘iddah for rij‘ī divorce (revocable divorce) (details of which will be explained under the rulings relating to 'Divorce'), and as a recommended precaution, it would be better that he does not marry her in the ‘iddah of the bā’in divorce (irrevocable divorce) [1] , and also in the waiting period of the temporary marriage, whether it is after the termination of the temporary marriage or after he has forgone its remaining time.

To Wed a Married Woman

Issue No. 2053- If a man contracts marriage with a woman knowing that she has a husband, he should get separated from her, and he cannot, on the basis of obligatory precaution, marry her afterwards, though he may not have had sexual intercourse with her.

Issue No. 2059Those with Whom Marriage Is Haraam

To Wed a Person who has Abandoned Nisa Tawaf

Issue No. 2059- If a man or woman does not perform ṭawāf al-nisā’ [a type of circumambulation around the Ka‘bah to be performed during ḥajj], women who had become haram to him owing to wearing Ihram, will not become halal to him. However, if they (the man or woman) perform ṭawāf al-nisā’ later, they become halal to each other.
