The Judge's Duty if One of Two Executors Dies

Issue No. 2342- If a person appoints two persons as joint executors, and if one of them dies, or becomes insane, or apostatizes, the Mujtahid or his representative will appoint another person in his place. And if both of them die or become insane or apostates, the Mujtahid or his representative will appoint two persons in their place.

Issue No. 1401Kaffārah for Fast

The Kaffārah of a Fast Is One of the Three Things

Issue No. 1401- The kaffāra of a fast is one of the three things:(a) to free a slave (b) to fast for two months (c) to completely feed sixty poor people. (It would be sufficient if he gives one mudd (roughly 750 grams) of food such as wheat, barley or similar things to each one of them). One is able to choose between either options, acknowledging that slaves no longer exist. One can give bread whose wheat should be equal to one mudd instead of wheat. Furthermore paying equal amount of money is not sufficient unless one is certain that the money will be spent for buying bread.

Issue No. 2299- If a person does not act according to the covenant made by him as per the above-mentioned conditions, he should offer kaffāra for it. The kaffāra for breaking a covenant is similar to the kaffāra for a vow, i.e., one should either feed sixty indigent persons or fast consecutively for two months (thirty-one fasts should be observed consecutively), or set a slave free. One is able to choose between either of the first two options, acknowledging that slaves no longer exist.

The Least Amount of Food Which Must Be Given to a Poor Person

Issue No. 1421- When a person has chosen the feeding of sixty poor people as his kaffāra, he must give one mudd of food to every indigent person if he has access to all of them, but he cannot give anyone of them more than one mudd, unless he has no access to sixty poor persons. In this case, if one is certain that the indigent person will give the food to each member of his family and will share the food with them, he can give one mudd of food for each member of his family, although they may be minors.

The Least Amount of Zakat that One can Pay

Issue No. 1682- As an obligatory precaution, a zakāt payer should not give less than the first taxable limit of silver, that is, 3.5 mithqāls (equal to 12.09 gms), to one poor person, and if he is giving something other than silver as zakāt, (e.g., wheat and barley), its value should not be less than this quantity either.

The Lost Property Which Bears No Sign

Issue No. 2193- If one finds a lost property which does not bear any sign by which its owner maybe known (e.g., paper money or a gold coin), the obligatory precaution is that it should be given as ṣadaqa on behalf of its owner, and if the finder himself is entitled to ṣadaqa, he can keep it for himself. However, if it is an important property, the obligatory precaution is that he should get the Mujtahid’s permission.

The Lost Property Which Bears a Sign

Issue No. 2194- If a person finds a property which bears a sign [to identify its owner] but its value is less than a dirham (equal to 12.6 chickpeas of coined silver) and its owner is known, he cannot pick it up without the permission of its owner. However, if its owner is not known the finder can pick it up and keep it as his own property. And if it perishes, it is not necessary to compensate for it. Even if he has not intended to own it and it perishes without it being his fault, it is not obligatory to give its substitute.

Issue No. 2271- According to narrations, there are a few acts which have been advised against while drinking water:1- To drink too much water.2- To drink water after eating fatty food.3- To drink water while standing during the night.4- To drink water with one’s left hand.5- To drink water from the side of the broken part of the pitcher, or from the side of its handle.

Issue No. 2067- A man cannot abandon having sexual intercourse with his permanent wife for more than four months, rather, if the wife is young, and there is this fear that during this period she might fall into sin, the obligatory precaution is that he must act in a way that she does not fall into sins.

The Meaning of

Issue No.1915- Agency means that a person who is religiously allowed to get involved in a certain act, delegates it to someone else to do on his behalf. For example, one may appoint someone as his agent to sell his house, or for contracting one's marriage with a woman. If he has the necessary conditions, it will be in order.
