The Hired Person Can Be the Opposite Gender

Issue No. 1221- A man can be hired on behalf of a woman, and a woman can be hired on behalf of a man, and in the matter of offering prayer loudly or whisperingly, the hired person should act according to his/her own obligation, not the dead person’s. Moreover, observing order is not necessary for the qaḍā prayer of a dead person irrespective of whether the hired person knows the order of the missed prayer or not, except for ẓuhr and ‘aṣr prayer or maghrib and ‘ishā’ prayer of the same day.

The Hired can not Hire himself to the other Person

Issue No.1857- If a labourer or a person is hired and employed by someone, the hirer cannot lease out his services to another person, unless it is understood from his words or action that the hirer has the option to do so. Then, in such a case, it is not permissible as an obligatory precaution, if he takes more money than the agreed wage for the hired person. However, this is permissible in cases other than a house, shop and a hired person.

Issue No. 1479- The property received by an indigent person under the title of khums or zakāt is not subject to khums even though it exceeds his annual expenses. In case however, he gains some benefits through this property given to him e.g. if he gets fruit from a tree he has received through khums and it exceeds his expenses for a year he should pay its khums.

The Intention of Fasting

Issue No. 1316- Fasting is one of the acts of worship; therefore, it is necessary to make an intention for fasting. When making an intention to fast, it is not necessary for a person to pass the intention for fasting through his mind or say it verbally. Rather, it is sufficient to determine that he will not perform any fast invalidators, from the time of fajr adhān up to maghrib, obeying the commands of Allah (swt).

The Issue Whose Fatwā Is Unknown to the Follower

Issue No.13- If a person faces a problem whose rule is not known to him, he can exercise precaution, or if its time does not expire he should wait until he has access to a Mujtahid, and in case he has no access to a Mujtahid, he should act on what he thinks to be the fatwā of the Mujtahid and should inquire about it later. Then if he finds his act to be in conformity with the fatwā of the Mujtahid, it is valid, otherwise, he should perform it again.

Issue No. 1134Journey for Haram Purpose

The Journey Should Not Be for a Haram Purpose

Issue No.1134- If a person travels in order to commit theft, treachery or other haram deeds, he should offer complete prayer. The same ruling applies when travelling itself is haram, for instance, when travelling involves a significant harm to one’s body, or when a wife travels without the permission of her husband (based on obligatory precaution), or when someone travels in spite of his parent's prohibition acknowledging the fact that it results in their annoyance. However, if the journey is obligatory upon him (e.g., an obligatory ḥajj), then the permission of the husband or parents is not necessary, therefore one should perform qaṣr prayer.
