The Conditions of the Lessor and the Lessee

Issue No.1850- The lease contract is an agreement under which someone rents out himself or his property to someone else. The person who gives something on lease as well as the person who takes it on lease should be mature and sane, should conclude the agreement with intention and out of free will, and they should legally be allowed to utilize their properties. Hence, it would be invalid to enter a contract with a mentally incompetent individual who is not able to manage his/her properties properly and uses them wastefully.

The Conditions under which Dust Invalidates Fast

Issue No. 1360- Allowing thick dust to reach one’s throat, if it is changed in to mud and goes down the throat, makes the fast void, irrespective of whether the dust is of something which is halal to eat, like flour, or of something which is haram to consume. As to inhalers for those suffering from asthma, since the medicine they give off is usually a light and thin gas, it will not render the fast void.

The Consent of One to whom Hawala is Given

Issue No.1956- If one refers his creditor to a person who is indebted to the former, it is necessary for him to accept it, but if he refers to a person who is not a debtor to him, it is not necessary for him to accept it. However, if one refers his creditor to a person who is indebted to the former but not the same commodity, for example, one who is indebted 100 kgs of wheat, refers the creditor [to his debtor] to get 100 kgs of barley instead, this will be in order, if the creditor accepts this referral.

Issue No.1156- When it comes to cities, normal cities should be considered as the criterion. Therefore if a city is situated at a very high or a very low place, it should be treated like normal cities; meaning we should observe the distance it takes in normal cities that he would not hear the adhān or that its residents would not be able to see him.

Issue No. 1470Mustahb Fasts

The Days on which Fasting is Mustahab

Issue No. 1470- Fasting is recommended on all days of the year except those days on which, as stated above, fasting is haram or makrūh. However, fasting is highly recommended on certain days, namely the following:1- The first and the last Thursdays of every month and the first Wednesday after the 10thof every month. It is even recommended to perform qaḍā if a person fails to observe fast on these days.2- 13th, 14th and 15th day of every month.3- All the days of the months of Rajab and Sha’ban; and in case one is not able to fast the whole two months he can fast for a few days, though it may be one day.4- 24th of the month of Dhu al-Hijjah and 29thof the month of Dhu al-Qi'dah.5- From the 1st to the 9th day of the month of Dhu al-Hijjah. However, if due to weakness one could not recite the supplications of the day of ‘Arafah , it is makrūh to observe fast on that day.6- he auspicious day of Ghadir (18th Dhu al-Hijjah)7- The 1st, 3rdand 7thday of Muharram.8- The birthday of the Holy Prophet(pbuh) (17th Rabi' al-awwal).9- The day of the commencement of the prophetic mission of the holy Prophet (ṣ) (27thof Rajab).10- Nowruz [1] day (21 March)

The Death of Farmer or the Owner of Land

Issue No.1894- If the owner of the land or the farmer dies after concluding the contract of Sharecropping, the contract will not be terminated and their heirs take their place. However, if the farmer dies and if they had agreed that the farmer himself would do the farming, the contract of Sharecropping will become cancelled, and in case the crop has appeared, his share should be given to his heirs, but the heirs cannot compel the landowner to allow the crop to stand on his land unless they would suffer loss as a consequence of removing it.

Issue No.527- If a person who is in the state of Ihram for ḥajj or ‘umrah dies before completing ṭawāf (i.e., circumambulation) and before sweet scents become Halal for him, ghusl should be performed on his body with pure water.

The Deceased Has Specified Someone to Carry Out His Death Rights

Issue No.522-If a dead person appoints someone other than his legal guardian to carry out his final procedures, i.e. if he has said that a particular person is to perform prayer on his dead body, it is obligatory to act accordingly, and the recommended precaution is to seek permission from his guardian too. However, it is not obligatory for the one appointed to accept this appointment, although it is better that he does, and if so, he must act upon it.
