Issue No. 2334Rules Regarding Will

Retrieving from Will

Issue No. 2334- If a person revokes his Will; for example if he says that 1⁄3 of his property should be given to a person and then says that it should not be given to him, the Will becomes void. And if he changes his Will, e.g., he appoints a legal guardian for his minor children and then replaces him with another person, his first Will becomes void and his second Will should be acted upon. And if he also conducts himself in a manner which shows that he has drawn back from his Will, for example, if he sells the house which he had willed to give away to someone, or appoints someone as his agent to sell it, the Will becomes void.

Returning a Woman's Husband who has Divorced Absentee

Issue No. 2107- If a woman who is sure that her husband died while on a journey, marries another man after completing the ‘iddah of death (waiting period that will be explained in the rules relating to divorce), and later her first husband returns from his journey, she should immediately separate from the second husband and she will be halal to her first husband. However, if the second husband has had sexual intercourse with her, she should observe ‘iddah and the obligatory precaution is that the second husband should give her the agreed mahr or the mahr equal to that of a woman in her status in case the agreed mahr is less than that.

Issue No. 2329Person's Duty When Observing the Signs of Death

Returning the Things Held In Trust to Their Owners

Issue No. 2329- When a person sees signs of death in himself, he should immediately return the things held in trust by him to their owners. And if he is indebted to others, and the time for repayment of the debt has matured, he should repay the debt. And if he is not in a position to repay the debt or the time for its repayment has not yet matured, he should make a Will, and if he is not sure that they will act according to his Will, he should make a Will in the presence of witnesses for its repayment. However, if he is certain that his heirs will repay his debts, it is not necessary to make a Will.

Issue No. 1448Rulings Regarding Fasting of a Traveler

Returning to Hometown Before or After Noon

Issue No. 1448- If a traveller reaches his hometown or a place where he intends to stay for ten days before ẓuhr, while he has not committed an act which invalidates fast, he should observe fast on that day. But if he has committed such an act, he should observe the qaḍā of that day later, and it is recommended to refrain from all invalidators for the rest of the day. However, if he arrives in the afternoon, he cannot observe fast on that day.

Issue No. 1250Rules of Congregational Prayer

Reverting Back to Congregational Prayer

Issue No. 1250- If because of a valid excuse the follower turns his intention into individual prayer during the congregational prayer, he cannot revert back to congregational prayer. Also, if he becomes doubtful whether he should change his intention to individual prayer or not, and eventually decides to continue the prayer with the congregation, the rulings of congregational prayer [as an obligatory precaution] do not apply to his prayer. However, if he doubts whether or not he had made the intention of individual prayer, he should consider that he had not made the intention.

Issue No. 2079- ‘iddah(waiting period) should be observed in temporary marriage (as will be explained in the divorce section), after its fixed duration has come to an end, and the children born from temporary marriage have all the rights of one’s children and inherit from their parents and their relatives, though the couple do not inherit from one another.

Issue No. 2160- If a person takes some money from his wife and makes a compromise to the effect that he will not return to her, or that he would not be entitled to return to her, it will not suffice and the right to return is not forfeited.

Issue No.927- In every Rak’at, a person offering prayers should, after reciting the Surahs (Qira’at), bow to an extent that he is able to rest his palms on his knees. Rather, the obligatory precaution is that he should rest his palms on his knees.
