Issue No. 289Third Condition: Water and the Place of Performing Wuḍū Should Be Mubāḥ

Performing Wuḍū with the Water of Mosques, Hussayniyahs or Inns

Issue No.289- If a person who does not want to perform prayer in a mosque or hussayniyah/imambargah and is not aware whether its water is endowed to the public, or specifically to those who perform prayer there, he cannot make wuḍū using that water. Similarly, performing wuḍū with the water of inns and guesthouses for the people who are not residing there is not valid, unless one can gather from the acts of religious people that the water in such places has been endowed for public use.

Performing Wuḍū with the Water of Private Creeks

Issue No.291- Performing wuḍū with the water of big or small private creeks is allowed, even if one is not sure whether their owners would allow it or not. However, if the owner explicitly prohibits performing wuḍū with that water, one should, as an obligatory precaution, refrain from making wuḍū with it. And in case the creek has been diverted without the permission of its owner, one should not perform wuḍū using it, as an obligatory precaution.

Perishing the Usurped Property

Issue No. 2188- If a thing usurped by a person perishes, in case it is among the things whose double is usually rare to find, like many animals and hand-woven carpets, he should pay its price, but if its market value has undergone a change, he should give the value of the day when it perished (if the usurper delays the paying from the day that thing perished then the average inflation rate must be added to the price). However, if the usurped thing is among those which are mass-produced and their double are available usually in abundance, like wheat, barley, machine carpets, various kinds of fabrics and utensils, then, he should give back the double of what he has usurped, but its qualification and characteristics should be the same as those of the usurped one.
